Privacy Policy
Effective date: November 3, 2026
Everly Studio ("Everly," "we," "us," or "our") is a brand of Fueled By You Inc, an Iowa corporation. We help families and funeral homes create personalized memorial products. We understand that the photographs, names, dates, and stories you share with us represent the memory of someone loved, and we treat that information with care. This Privacy Policy explains what we collect, how we use it, and the choices you have.
This Policy applies to everlydesignstudio.com, the Everly design studio application, and related services (together, the "Service"), including when you use the Service through a funeral home that works with Everly.
Information we collect
We collect the following categories of information:
Account information. Your name, email address, and password when you create an account, along with any contact or profile details you add.
Memorial content you provide. The photographs, names, dates, biographical details, and personal stories you upload or enter about the person being memorialized and, where you choose to include them, about family members. This may include an obituary link if you provide one.
Order and payment information. The products you design and order, and billing and delivery details. Payments are processed by our payment provider, Stripe. We do not collect or store full payment card numbers on our own systems.
Communications. Messages you send us, proofs you review, and approvals you give.
Information collected automatically. Basic device, log, and usage information, and similar data collected through cookies and comparable technologies to operate and improve the Service.
How we use information
We use the information we collect to:
create and produce the memorial design and products you request; fulfill, deliver, and support your order; prepare proofs and process your approvals; operate, secure, maintain, and improve the Service; communicate with you about your account, orders, and support requests; and comply with our legal obligations.
How we use artificial intelligence
Everly uses artificial intelligence tools to help generate and refine designs based on the information you provide. We do not submit identifiable family content to third-party AI models for the purpose of training those models without your consent. You always review and approve a final proof before anything is produced.
How we share information
We share information only as described here:
Funeral home partners. If you use the Service through a funeral home, we share information with that funeral home as needed to coordinate and fulfill the memorial you are creating together.
Service providers. We share information with vendors who perform services for us, including hosting and database providers that run our application, our payment processor (Stripe), and the print and production partners who manufacture the physical products you order. These providers may use the information only to perform services for us.
Legal and safety. We may disclose information if required by law or legal process, or to protect the rights, property, or safety of Everly, our customers, or others.
Business transfers. If Everly is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
Text messages
If you or your funeral home give us a mobile number, we use it only to send the text messages you asked for: a private link to share memories of a loved one, and sign-in codes. Message frequency varies. Message and data rates may apply. Reply STOP to stop receiving texts, or HELP for help.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Our texting provider, Twilio, processes mobile numbers only to deliver our messages.
How long we keep information
We keep information only as long as we need it, counted from the date of the service (or from the first arrangement meeting if no service date is set):
- 6 months: we delete recordings of arrangement meetings and of family members sharing memories, their transcripts, original photos family members uploaded through a story link, and family members' phone numbers. The story link stops working. Until then, family members and the funeral home can save a copy of any recording.
- 2 years: we delete written memories family members shared, and photos they sent that were not used in a design, so that anything the funeral home posted on its website can stay up during that time.
- 4 years: we delete the record that a person agreed to receive text messages (the number, the time, and the wording they agreed to). We keep it this long only to show that consent was given.
- 7 years: we delete orders, payment, payout, and invoice records, which we keep to meet tax and accounting requirements.
The funeral home's record of the arrangement, including the loved one's name, dates, obituary, and finished designs, is kept for the funeral home while it uses the Service so the family can reorder. A funeral home or family may ask us to delete content sooner as described below, and we will honor those requests subject to any records we are required to retain.
How we protect information
We use administrative, technical, and organizational measures designed to protect the information we hold. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to safeguard your information and to respond appropriately if an incident occurs.
Your choices and rights
You can review and update your account information at any time by signing in. You may request access to, correction of, or deletion of your personal information, and you may opt out of marketing messages. Depending on where you live, you may have additional rights under applicable privacy laws, including the right to know what personal information we hold and the right to request its deletion. To make a request, contact us at privacy@everlydesignstudio.com. We will not discriminate against you for exercising your rights.
Information about the person being memorialized
Memorial designs necessarily include information about a person who has died, and often photographs that show living family members. When you upload this content, you confirm that you have the authority to share it with us and to allow us to use it to create the memorial you order. We use the name, image, and likeness of the person being memorialized only to produce and support your order. We will not use that content for our own marketing unless you give us separate, express permission.
Children's privacy
The Service is intended for use by adults. It is not directed to children, and we do not knowingly collect personal information directly from children. Memorials that honor a child are created by the adults who order them.
Cookies and analytics
We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Service is used so we can improve it. You can control cookies through your browser settings; disabling some cookies may affect how the Service works.
Changes to this Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice.
